Scope of Protection

U.S. Design Patent D907,766 protects the ornamental appearance of the injector as depicted in the patent figures. Pursuant to 35 U.S.C. § 171, U.S. design patent protection extends to the visual ornamental characteristics embodied in, or applied to, an article of manufacture. Infringement is determined under the “ordinary observer” test established in Gorham Co. v. White, 81 U.S. 511 (1871), and remedies include disgorgement of the infringer’s total profit pursuant to 35 U.S.C. § 289.
